Terms and Conditions for Cranmer’s Substack
Effective Date: 27 February 2025
Cranmer’s Substack is dedicated to providing considered, diligently researched content, underpinned by a commitment to intellectual integrity and material accuracy at the time of publication. As the sole author, I endeavour to maintain a high standard of clarity and substance, while retaining the discretion to issue corrections or clarifications as circumstances warrant. The following terms set out the basis upon which this content is made available to you. I appreciate your engagement with my writing and support for my work.
These Terms and Conditions (the “Terms”) govern your access to, and use of, Cranmer’s Substack, a publication authored by Philip Crump, providing commentary and analysis on politics, culture, and law. By subscribing, accessing, or engaging with this publication, you agree to be bound these Terms. If you do not accept them, you should refrain from using this service.
1. Scope of Service
Cranmer’s Substack provides digital content, including articles and posts, available in free and paid tiers. Paid subscriptions include additional benefits such as access to archived content, exclusive articles, and commenting privileges.
The content is authored by Philip Crump and reflects personal commentary and analysis, expressed in a personal capacity. It does not constitute legal advice, professional services, or reflect the views of any organisation with which the author is affiliated.
Free articles are archived one month after publication and thereafter are accessible only to paid subscribers. The author reserves the right to modify this archiving period without notice.
The service may evolve, and material modifications to its offerings will be communicated to subscribers with reasonable notice. Minor changes may be made without notice.
2. Author’s Rights
All content published on Cranmer’s Substack is the copyright and intellectual property of Philip Crump or used under licence. Philip Crump retains absolute discretion over the publication, modification, and removal of content, including user comments.
The author is bound by professional and governance obligations, which may include political neutrality. Content is published with the intention of adhering to those standards.
The author may use artificial intelligence tools for research assistance, however all published content reflects the author’s own work, judgment, and expression.
The author may suspend or discontinue Cranmer’s Substack at any time, providing notice to subscribers where reasonably practicable.
3. User Obligations
Reproduction, distribution, or commercial use of any content published by Cranmer’s Substack without prior written consent is prohibited, except as permitted under applicable copyright law, such as fair dealing in New Zealand. Non-commercial sharing with attribution is permitted and encouraged, for example, to friends, family, or colleagues.
Paid subscribers with commenting privileges must refrain from unlawful, abusive, or defamatory conduct. Comments are reviewed for compliance with these Terms and may be removed for reasons including illegality, harassment, or irrelevance, at the author’s absolute discretion. The author may temporarily or permanently suspend commenting privileges for non-compliance.
4. Subscriptions and Payment
Free subscriptions are available at no cost upon providing an email address via Substack’s platform. Instructions on how to unsubscribe are available on Substack’s support pages.
Paid subscriptions are priced as indicated in New Zealand Dollars and processed through Substack’s payment provider, Stripe. Payments may be processed in subscribers’ local currencies, with amounts converted to New Zealand Dollars by Stripe, subject to applicable conversion fees.
Subscriptions renew automatically on a monthly or annual basis, depending on the plan selected. Prices may be adjusted annually at the author’s discretion, with notice provided to subscribers where practicable.
Subscribers may terminate their paid subscription at any time through Substack’s interface, halting future billing. Subscribers facing cancellation difficulties should contact Substack support for assistance. It is the subscriber’s responsibility to ensure cancellation is completed successfully, and subscribers should retain confirmation of cancellation, such as via email or account status, as proof of termination. Instructions on how to cancel a paid subscription are available on Substack’s support pages.
No refunds will be issued except in exceptional circumstances, determined at the author’s sole discretion. The author is not responsible for technical issues, user errors, or delays in cancelling subscriptions, nor for manually processing cancellations on behalf of subscribers.
The author may terminate subscriptions at his absolute discretion, including for violations of these Terms or Substack’s policies, with no obligation to refund.
5. Limitation of Liability
Content is provided “as is” without warranties of accuracy, completeness, or suitability for any purpose, except that the author undertakes reasonable efforts to ensure material accuracy at the time of publication. The author reserves the right to issue corrections or clarifications at his sole discretion.
The author accepts no liability for the content, accuracy, or consequences of comments posted by subscribers. Subscribers are solely responsible for their contributions, and such comments do not reflect the author’s views or endorsements.
To the fullest extent permitted by law, the author expressly disclaims liability for any data breaches, service disruptions, or technical failures arising from Substack’s or Stripe’s systems, as these are beyond the author’s control. Subscribers acknowledge that responsibility for such incidents rests with Substack or Stripe in accordance with their respective terms and conditions.
The author is not liable for service interruptions due to unforeseen events, including technical failures, legal restrictions, or other circumstances beyond the author’s control.
6. General Provisions
These Terms may be amended periodically. Subscribers will be notified of material changes via email or a Substack post. Continued use constitutes acceptance of the updated Terms.
These Terms should be read together with Substack’s Terms of Use, which govern platform operations. In case of inconsistency, Substack’s Terms of Use govern platform-specific matters, while these Terms govern content and subscription matters.
7. Governing Law
These Terms are governed by, and construed in accordance with, the laws of New Zealand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
